What is the BE-12 Survey?

The BE-12 survey is a benchmark survey conducted by the U.S. Bureau of Economic Analysis (BEA) to gather essential data on foreign direct investment (FDI) in the United States. This survey collects detailed information on financial and operational aspects of U.S. businesses with foreign ownership to better understand economic impacts and foreign influence on the U.S. economy.

Who Needs to File the BE-12 Survey?

The BE-12 survey applies to any U.S.-based business where a foreign individual or entity holds at least 10% ownership of the voting securities. This includes corporations, partnerships, and other entities with significant foreign investments, making it a critical requirement for businesses with international ties to maintain compliance.

Survey Frequency

The BE-12 survey is conducted every five years, ensuring a comprehensive and periodic evaluation of foreign-owned U.S. businesses to keep economic data accurate and up to date.

Penalties for Non-Compliance

Failing to file the BE-12 survey can lead to severe penalties, both civil and legal. Civil penalties range from $5,580 to $55,808 per violation. Additionally, non-compliant entities may face injunctive relief, which could lead to further legal action to enforce compliance.
